Dar, cine e vinovat dac\u0103 pietonul traverseaz\u0103 pe trecere f\u0103r\u0103 s\u0103 se asigure?<\/p>\n\n\n\n<p>Principala cauz\u0103 a deceselor \u00een urma&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/ce-faci-cand-soferul-vinovat-iti-da-date-de-pe-o-asigurare-expirata-procedura-in-caz-de-accidente-usoare-19257363\">accidentelor<\/a>&nbsp;rutiere \u00een Rom\u00e2nia este indisciplina pietonilor. Traversarea neregulamentar\u0103 a fost una dintre principalele cauze de producere a accidentelor grave petrecute \u00een 2023, potrivit datelor furnizate de Ministerul Afacerilor Interne.<\/p>\n\n\n\n<p>Dar, cine e vinovat atunci c\u00e2nd o persoan\u0103 care traverseaz\u0103 pe trecerea de pietoni f\u0103r\u0103 s\u0103 se asigure e accidentat\u0103?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cine e vinovat dac\u0103 pietonul traverseaz\u0103 pe trecere f\u0103r\u0103 s\u0103 se asigure?<\/h2>\n\n\n\n<p>Codul Rutier actualizat prevede c\u0103 to\u021bi&nbsp;pietonii sunt obliga\u021bi s\u0103 se asigure atunci c\u00e2nd traverseaz\u0103 pe la trecerea de&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/un-urs-a-fost-filmat-in-timp-ce-traverseaza-pe-o-trecere-de-pietoni-din-sinaia-video-18875992\">pietoni<\/a>.<\/p>\n\n\n\n<p>\u201e<em><strong>Traversarea drumului public de c\u0103tre pietoni se face perpendicular pe axa acestuia, numai prin locurile special amenajate \u015fi semnalizate corespunz\u0103tor, iar \u00een lipsa acestora, \u00een localit\u0103\u0163i, pe la col\u0163ul str\u0103zii, numai dup\u0103 ce s-au asigurat c\u0103 o pot face f\u0103r\u0103 pericol pentru ei \u015fi pentru ceilal\u0163i participan\u0163i la trafic<\/strong><\/em>\u201d, se arat\u0103 \u00een Art. 72 (3) din&nbsp;<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/74028\" target=\"_blank\" rel=\"noreferrer noopener\">OUG nr. 195\/2002<\/a>.<\/p>\n\n\n\n<p>A\u0219adar, chiar dac\u0103 \u0219oferii sunt obliga\u021bi s\u0103 acorde prioritate celor care traverseaz\u0103 pe trecerea de pietonii, la r\u00e2ndul lor cei care urmeaz\u0103 s\u0103 treac\u0103 strada sunt obliga\u021bi s\u0103 se asigure. Deci, nu se pot angaja \u00een traversare dec\u00e2t dup\u0103 ce vehiculele s-au oprit pentru a le permite trecerea.<\/p>\n\n\n\n<p>\u201e<em><strong>Pietonii surprin\u015fi \u015fi accidenta\u0163i ca urmare a travers\u0103rii prin locuri nepermise, la culoarea ro\u015fie a semaforului destinat acestora, sau a nerespect\u0103rii altor obliga\u0163ii stabilite de normele rutiere poart\u0103 \u00eentreaga r\u0103spundere a accident\u0103rii lor, \u00een condi\u0163iile \u00een care conduc\u0103torul vehiculului respectiv a respectat prevederile legale privind circula\u0163ia prin acel sector<\/strong><\/em>\u201d, se stabile\u0219te prin Art. 72 (4) din legea circula\u021biei.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00cen ce situa\u021bii e interzis\u0103 traversarea<\/h2>\n\n\n\n<p>Sunt mai multe situa\u021bii \u00een care&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/pietonii-obligati-sa-se-asigure-trecerea-de-pietoni-18894510\">traversarea<\/a>&nbsp;drumului, chiar \u0219i pe la trecea de pietoni, este interzis\u0103.<\/p>\n\n\n\n<p>Conform legii, prin Art. 167 se interzice pietonilor \u0219i persoanelor asimilate acestora:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>s\u0103 se angajeze \u00een traversarea drumului public atunci c\u00e2nd se apropie un autovehicul cu regim de circula\u0163ie prioritar\u0103 care are \u00een func\u0163iune semnalele speciale de avertizare luminoase \u015fi sonore;<\/li>\n\n\n\n<li>s\u0103 traverseze partea carosabil\u0103 prin fa\u0163a sau prin spatele vehiculului oprit \u00een sta\u0163iile mijloacelor de transport public de persoane, cu excep\u0163ia cazurilor \u00een care exist\u0103 treceri pentru pietoni, semnalizate corespunz\u0103tor;<\/li>\n\n\n\n<li>s\u0103 prelungeasc\u0103 timpul de traversare a drumului public, s\u0103 se opreasc\u0103 ori s\u0103 se \u00eentoarc\u0103 pe trecerile pentru pietoni care nu sunt prev\u0103zute cu semafoare;<\/li>\n\n\n\n<li>s\u0103 traverseze drumul public prin alte locuri dec\u00e2t cele permise;<\/li>\n\n\n\n<li>s\u0103 ocupe partea carosabil\u0103 \u00een scopul \u00eempiedic\u0103rii circula\u0163iei.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Cine e vinovat pietonul traverseaz\u0103 prin loc nepermis<\/h2>\n\n\n\n<p>\u00cen situa\u021bia \u00een care un \u0219ofer love\u0219te cu ma\u0219ina un pieton care traverseaz\u0103 prin loc&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/o-vulpe-a-fost-filmata-in-timp-ce-traverseaza-regulamentar-un-bulevard-din-bucuresti-video-18770372\">nepermis<\/a>, autorit\u0103\u021bile analizeaz\u0103 mai multe aspecte.<\/p>\n\n\n\n<p>\u00cen primul r\u00e2nd, se va deschide dosar penal de v\u0103t\u0103mare corporal\u0103 sau ucidere din culp\u0103.<\/p>\n\n\n\n<p>Ancheta va trebui s\u0103 stabileasc\u0103 apoi cauzele care au dus la producerea accidentului \u0219i gradul de vinov\u0103\u021bie al celor implica\u021bi. De exemplu, dac\u0103 \u0219oferul a respectat toate regulile de circula\u021bie, atunci \u00eentreaga vin\u0103 o va purta pietonul accidentat.<\/p>\n\n\n\n<p>Dar, dac\u0103 \u0219oferul circula cu o vitez\u0103 mai mare dec\u00e2t limita impus\u0103 pe acel tronson, de exemplu, atunci instan\u021ba de judecat\u0103 poate stabili o culp\u0103 comun\u0103.
