De exemplu, dac\u0103 din sensul cel\u0103lalt se apropie un biciclist sau o c\u0103ru\u021b\u0103, este legal s\u0103 intri \u00een dep\u0103\u0219ire?<\/p>\n\n\n\n<p>\u0218oferii care urmeaz\u0103 s\u0103 intre \u00een&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/daca-un-sofer-face-o-depasire-neregulamentara-esti-obligat-sa-l-lasi-sa-intre-in-fata-ta-19286751\">dep\u0103\u0219ire<\/a>&nbsp;au obliga\u021bia de a se asigura c\u0103 nu incomodeaz\u0103 \u00een niciun fel traficul. \u0218i nici nu pun \u00een pericol circula\u021bia prin aceast\u0103 manevr\u0103.<\/p>\n\n\n\n<p>Legea rutier\u0103 stabile\u0219te c\u0103 \u0219oferii trebuie s\u0103 \u00ee\u0219i ia m\u0103suri de precau\u021bie at\u00e2t \u00een ceea ce prive\u0219te traficul din fa\u021b\u0103, c\u00e2t \u0219i raportat la cei din spate, atunci c\u00e2nd dep\u0103\u0219esc un alt vehicul.<\/p>\n\n\n\n<p>Iar aceste reguli se aplic\u0103 \u0219i atunci c\u00e2nd \u00eent\u00e2lnesc o c\u0103ru\u021b\u0103, un tractor sau un biciclist pe sensul lor de mers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cum po\u021bi dep\u0103\u0219i legal un biciclist<\/h2>\n\n\n\n<p>Dac\u0103 sunte\u021bi \u00een spatele unui biciclist, pentru a-l dep\u0103\u0219i legal trebuie s\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>trece\u0163i cu ro\u021bile peste marcajul care desparte benzile sau sensurile de circula\u021bie, c\u00e2nd v\u0103 afla\u021bi pe un drum unde viteza maxim\u0103 admis\u0103 este de p\u00e2n\u0103 \u00een 50 km\/h;<\/li>\n\n\n\n<li>dep\u0103\u0219i\u021bi cu mai mult de o jum\u0103tate de ma\u0219in\u0103\u00a0<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/ai-voie-sa-incalci-linia-continua-daca-depasesti-o-caruta-sau-un-tractor-ce-prevede-legea-rutiera-19234111\">marcajul<\/a>\u00a0longitudinal, c\u00e2nd circula\u021bi pe un drum unde viteza maxim\u0103 admis\u0103 e de peste 50 km\/h<\/li>\n\n\n\n<li>biciclistul sau cel aflat pe trotinet\u0103 circul\u0103 pe pista sau pe acostamentul drumului.<\/li>\n<\/ul>\n\n\n\n<p>\u201e<em><strong>Dac\u0103 un drum este prev\u0103zut cu o pist\u0103 pentru biciclete, bicicletele \u0219i trotinetele electrice vor fi conduse numai pe pista respectiv\u0103. \u00cen lipsa acestei piste, circula\u021bia trotinetelor electrice este permis\u0103 numai pe sectoarele de drum unde viteza maxim\u0103 admis\u0103 pentru circula\u021bia vehiculelor este de 50 km\/h<\/strong><\/em>\u201d stabile\u0219te Art. 41 (3) din legea circula\u021biei.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ai voie s\u0103 \u00eencalci linia continu\u0103 dac\u0103 dep\u0103\u0219e\u0219ti un vehicul lent?<\/h2>\n\n\n\n<p>Conform legii rutiere din Rom\u00e2nia, este interzis\u0103 efectuarea unei dep\u0103\u0219iri \u00een anumite condi\u021bii.<\/p>\n\n\n\n<p>\u201e<em><strong>Se interzice&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/este-legal-sa-incepi-depasirea-pe-linie-punctata-si-sa-o-inchei-pe-linie-continua-ce-prevede-legea-rutiera-19264428\">dep\u0103\u0219irea&nbsp;<\/a>vehiculelor pe pasaje denivelate, pe poduri, sub poduri \u0219i \u00een tuneluri. Prin excep\u021bie, pot fi dep\u0103\u0219ite \u00een aceste locuri vehiculele cu trac\u021biune animal\u0103, motocicletele f\u0103r\u0103 ata\u0219, mopedele \u0219i bicicletele, dac\u0103 vizibilitatea asupra drumului este asigurat\u0103 pe o distan\u021b\u0103 mai mare de 20 m, iar l\u0103\u021bimea drumului este de cel pu\u021bin 7 m<\/strong><\/em>\u201d, stabile\u0219te legea circula\u021biei.<\/p>\n\n\n\n<p>A\u0219adar, ai voie s\u0103 dep\u0103\u0219e\u0219ti \u00een aceste zone o&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/este-obligatorie-casca-pentru-biciclisti-ce-obligatii-au-cei-care-circula-cu-bicicleta-pe-drumurile-publice-19217667\">biciclet\u0103<\/a>&nbsp;sau o persoan\u0103 aflat\u0103 pe trotinet\u0103, dar numai dac\u0103 ai vizibilitate \u0219i nu st\u00e2njene\u0219ti circula\u021bia celor care vin din sens opus.<\/p>\n\n\n\n<p>Dar, legisla\u021bia nu prevede nicio excep\u021bie pentru \u00eenc\u0103lcarea marcajului rutier. Deci, legal, nu po\u021bi dep\u0103\u0219i un vehicul lent dac\u0103 prin asta \u00eencalci linia continu\u0103.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cum se face o dep\u0103\u0219ire \u00een mod legal<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.promotor.ro\/stiri-auto\/amenda-de-peste-100-000-de-euro-pentru-depasirea-limitei-de-viteza-cu-30-km-h-19186029\">Dep\u0103\u0219irea<\/a>&nbsp;se poate face, \u00een general, \u00een trei moduri:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pe contrasens, \u00een cazul drumurilor cu o singur\u0103 band\u0103 pe sens;<\/li>\n\n\n\n<li>pe alt\u0103 band\u0103 de circula\u021bie, aflat\u0103 pe aceea\u0219i direc\u021bie de mers, \u00een cazul drumurilor prev\u0103zute cu cel pu\u021bin 2 benzi pe sens;<\/li>\n\n\n\n<li>pe banda din mijloc, \u00een cazul drumurilor cu o band\u0103 dedicat\u0103 dep\u0103\u0219irii pentru vehiculele din ambele sensuri.<\/li>\n<\/ul>\n\n\n\n<p>Dep\u0103\u0219irea prin dreapta este interzis\u0103, cu excep\u021bia urm\u0103toarelor cazuri:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la dep\u0103\u0219irea tramvaielor, care se face, de regul\u0103, prin\u00a0<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/2024-este-legala-depasirea-prin-dreapta-a-unei-masini-care-face-viraj-la-stanga-ce-prevede-codul-rutier-19279174\">dreapta<\/a>; dep\u0103\u0219irea acestora prin st\u00e2nga se face numai pe o strad\u0103 cu sens unic sau c\u00e2nd nu exist\u0103 suficient spa\u021biu de dep\u0103\u0219ire prin dreapta;<\/li>\n\n\n\n<li>c\u00e2nd drumul este prev\u0103zut cu cel pu\u021bin 2 benzi pe sens, iar vehiculul care urmeaz\u0103 s\u0103 fie dep\u0103\u0219it circula pe banda din mijloc.<\/li>\n<\/ul>\n\n\n\n<p>Regulile pe care conduc\u0103torul de vehicul care efectueaz\u0103 dep\u0103\u0219irea este obligat s\u0103 le respecte sunt:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>s\u0103 se asigure c\u0103 cel din spate sau din fa\u021b\u0103 nu a semnalizat, la r\u00e2ndul lui, intrarea \u00een dep\u0103\u0219ire;<\/li>\n\n\n\n<li>s\u0103 se asigure c\u0103 nu pune \u00een pericol \u0219i nici nu \u00eencurc\u0103\u00a0<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/circulatia-in-sensul-giratoriu-dupa-modificarile-din-codul-rutier-cum-se-schimba-benzile-cum-se-acorda-prioritate-si-cum-semnalizezi-corect-video-19171207\">circula\u021bia<\/a>\u00a0din sens opus;<\/li>\n\n\n\n<li>s\u0103 semnalizeze inten\u021bia de efectuare a dep\u0103\u0219irii;<\/li>\n\n\n\n<li>s\u0103 p\u0103streze \u00een timpul dep\u0103\u0219irii o distan\u021b\u0103 lateral\u0103 suficient\u0103 fa\u021b\u0103 de vehiculul dep\u0103\u0219it;<\/li>\n\n\n\n<li>s\u0103 reintre pe banda sau \u00een \u0219irul de circula\u021bie ini\u021bial dup\u0103 ce a semnalizat \u0219i s-a asigurat c\u0103 poate efectua aceast\u0103 manevr\u0103 \u00een condi\u021bii de siguran\u021b\u0103.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Po\u021bi dep\u0103\u0219i atunci c\u00e2nd pe contrasens circul\u0103 un biciclist sau o c\u0103ru\u021b\u0103?<\/h2>\n\n\n\n<p>Legea rutier\u0103 stabile\u0219te care sunt condi\u021biile \u00een care un \u0219ofer poate \u00eencepe manevra de dep\u0103\u0219ire.<\/p>\n\n\n\n<p>\u201e<em><strong>Atunci c\u00e2nd prin manevra de dep\u0103\u015fire se trece peste axa care separ\u0103 sensurile de circula\u0163ie, conduc\u0103torii de vehicule trebuie s\u0103 se asigure c\u0103 din sens opus nu se apropie un vehicul \u015fi c\u0103 dispun de spa\u0163iu suficient pentru a reintra pe banda ini\u0163ial\u0103, unde au obliga\u0163ia s\u0103 revin\u0103 dup\u0103 efectuarea manevrei de dep\u0103\u015fire<\/strong><\/em>\u201d, se precizeaz\u0103 \u00een Art. 45 (3) din Codul Rutier.<\/p>\n\n\n\n<p>A\u0219adar, dac\u0103 prin p\u0103trunderea pe contrasens pui \u00een pericol un alt participant la trafic, atunci manevra de dep\u0103\u0219ire este neregulamentar\u0103.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0218oferii pot r\u0103m\u00e2ne f\u0103r\u0103 permis dac\u0103 \u00eencalc\u0103 regulile de dep\u0103\u0219ire<\/h2>\n\n\n\n<p>Cei care \u00eencalc\u0103 regulile de dep\u0103\u0219ire, r\u0103m\u00e2n f\u0103r\u0103 permis pentru 30 de zile.<\/p>\n\n\n\n<p>\u201e<em><strong>Constituie contraven\u021bie \u0219i se sanc\u021bioneaz\u0103 cu amenda prev\u0103zut\u0103 \u00een clasa a II-a de sanc\u021biuni \u0219i cu aplicarea sanc\u021biunii contraven\u021bionale complementare a suspend\u0103rii exercit\u0103rii dreptului de a conduce pentru o perioad\u0103 de 30 de zile [\u2026] nerespectarea regulilor privind dep\u0103\u0219irea<\/strong><\/em>\u201d, conform Art. 100 (3), din OUG 195\/2002.<\/p>\n\n\n\n<p>A\u0219adar, cel care \u00eencalc\u0103 regulile de dep\u0103\u0219ire va primi \u00eentre 4 \u0219i 5 puncte de\u00a0<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/cat-timp-poti-conduce-pe-contrasens-sanctiuni-usturatoare-pentru-incalcarea-regulilor-de-depasire-19212142\">amend\u0103<\/a>.
