Mai exact caprioara a s\u0103rit \u00een fa\u021ba ma\u0219inii, iar \u0219oferul nu a mai putut evita impactul. Este vorba despre un dosar finalizat recent pe rolul Tribunalului Alba.<\/strong><\/p>\n\n\n\n<p id=\"p-2\"><strong>\u00cen data de 20 martie 2025, magistra\u021bii instan\u021bei au dat o decizie favorabil\u0103 companiei de asigur\u0103ri, asta dup\u0103 ce Judec\u0103toria Alba Iulia a respins cererea companiei, la instan\u021ba de fond.&nbsp;<\/strong><\/p>\n\n\n\n<p id=\"p-3\">\u00cen linii mari cazul a fost unul simplu. \u00cen data de 5 aprilie 2023, un \u0219ofer conducea un autoturism pe drumul DN14B. La un moment dat o c\u0103prioar\u0103 i-a s\u0103rit \u00een fa\u021b\u0103, de pe marginea drumului. \u0218oferul nu a mai putut evita impactul \u0219i a lovit frontal animalul.<\/p>\n\n\n\n<p id=\"p-4\">\u00cen urma accidentului autoturismul care era asigurat CASCO a suferit avarii. \u00cen total a fost vorba despre suma de 12.642.44 lei.<\/p>\n\n\n\n<p id=\"p-5\">La Judec\u0103toria Alba Iulia, compania de asigur\u0103ri a cerut c\u0103tre CNAIR s\u0103 desp\u0103gubeasc\u0103 suma de bani deoarece compania de stat este administratorul drumului.<\/p>\n\n\n\n<p id=\"p-6\">Magistra\u021bii instan\u021bei de fond au precizat c\u0103 administratorul drumului a semnalizat corespunz\u0103tor c\u0103 \u00een zon\u0103 sunt animale s\u0103lbatice \u0219i drept urmare nu poate fi tras la r\u0103spundere.<\/p>\n\n\n\n<p id=\"p-7\">\u201dJudec\u0103toria a constatat c\u0103, p\u00e2r\u00e2ta (n.r. CNAIR) \u015fi-a \u00eendeplinit obliga\u0163ia de a semnaliza corespunz\u0103tor drumul pe care \u00eel administreaz\u0103, din perspectiva angaj\u0103rii r\u0103spunderii delictuale \u00een cazul accidentelor rutiere provocate de speciile de faun\u0103 s\u0103lbatic\u0103, fiind montate indicatoare rutiere de avertizare Aten\u0163ie animale, astfel c\u0103 nu r\u0103spunde delictual fa\u0163\u0103 de asigur\u0103torul autovehiculului implicat \u00een accident\u201d, se arat\u0103 \u00een instan\u021ba de fond.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Decizie la Tribunalul Alba: Judec\u0103toria Alba Iulia a gre\u0219it<\/h3>\n\n\n\n<p id=\"p-8\">Tribunalul a apreciat c\u0103 instan\u0163a de fond a procedat gre\u015fit resping\u00e2nd ac\u0163iunea invoc\u00e2nd, \u00een motivare, faptul c\u0103, potrivit \u00eenscrisurilor de la dosar, la momentul evenimentului rutier, drumul era prev\u0103zut cu indicatoare de Avertizare animale. Astfel, accidentul s-a produs pe DN14B la km. 20 + 700 metri.<\/p>\n\n\n\n<p id=\"p-9\">Mai exact, indicatoarele care avertizeaz\u0103 asupra sectoarelor periculoase sunt \u00eenso\u021bite de pl\u0103cu\u021be adi\u021bionale care stabilesc zona de ac\u021biune. Acestea se amplaseaz\u0103 \u00eenaintea locului periculos, la distan\u021be diferite \u00een func\u021bie de tipul drumului: p\u00e2n\u0103 la 50 metri \u00een localit\u0103\u021bi, \u00eentre 100 \u0219i 250 metri \u00een afara localit\u0103\u021bilor, \u0219i \u00eentre 500 \u0219i 1.000 metri pe autostr\u0103zi \u0219i drumuri expres.<\/p>\n\n\n\n<p id=\"p-10\">Dac\u0103 indicatorul trebuie amplasat la o distan\u021b\u0103 mai mare, se adaug\u0103 un panou care precizeaz\u0103 distan\u021ba p\u00e2n\u0103 la pericol. Pe autostr\u0103zi \u0219i drumuri expres, aceste panouri sunt obligatorii. Dac\u0103 sectorul periculos dep\u0103\u0219e\u0219te 1.000 metri, se instaleaz\u0103 \u0219i un panou care indic\u0103 lungimea acestuia.<\/p>\n\n\n\n<p id=\"p-11\">Iar \u00een zona respectiv\u0103, indicatorul nu avea pl\u0103cu\u0163\u0103 adi\u0163ional\u0103 pentru a indica o zon\u0103 mai mare de ac\u0163iune dec\u00e2t cea prev\u0103zut\u0103 de lege.<\/p>\n\n\n\n<p id=\"p-12\">Drept urmare Tribunalul Alba a admis apelul \u0219i a obligat s\u0103 pl\u0103teasc\u0103 reclamantei suma de 12.642,44 lei, cu titlu desp\u0103gubiri, precum \u015fi la plata dob\u00e2nzii legale penalizatoare aferente.<\/p>\n\n\n\n<p id=\"p-13\">Decizia Tribunalului Alba a fost definitiv\u0103.<\/p>\n\n\n\n<p>Sursa\/foto:alba24<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>CNAIR este bun\u0103 de plat\u0103 dup\u0103 ce ma\u0219ina unui \u0219ofer a fost lovit\u0103 de o c\u0103prioar\u0103.
