Lucrurile s-au l\u0103murit \u00eens\u0103 \u00een apel, dup\u0103 7 ani: groapa era 100% a municipalit\u0103\u021bii. Ma\u0219ina avea asigurare CASCO, \u00eencheiat\u0103 la Omniasig SA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Cum s-a ap\u0103rat Prim\u0103ria?<\/strong><\/h2>\n\n\n\n<p>Asigur\u0103torul a pl\u0103tit, dar a c\u0103utat apoi s\u0103-\u0219i recupereze banii de la administratorul drumului, conform legii. Ne\u0219tiind exact cui apar\u021binea \u0219oseaua, Omniasig SA a chemat \u00een judecat\u0103 Prim\u0103ria, ca administrator al str\u0103zilor din ora\u0219 \u0219i Direc\u021bia Regional\u0103 de Drumuri \u0219i Poduri, administratoarea drumurilor na\u021bionale de pe raza jude\u021bului. DRDP nu avea de fapt nimic de a face cu \u0219oseaua B\u00e2rnova. Deci, dac\u0103 era de pl\u0103tit, Delgaz Grid SA trebuia s\u0103 o fac\u0103. \u00cen al treilea r\u00e2nd, nu se demonstrase c\u0103 avarierea ma\u0219inii se produsese exclusiv din cauza impactului ma\u0219inii cu groapa.<\/p>\n\n\n\n<p>\u00cen plus, constatarea \u00eentinderii prejudiciului fusese f\u0103cut\u0103 de societatea de asigur\u0103ri, f\u0103r\u0103 ca Prim\u0103ria s\u0103 aib\u0103 posibilitatea de a-\u0219i spune p\u0103rerea. Nu \u00een ultimul r\u00e2nd, Omniasig SA solicita contravaloarea unor piese noi, f\u0103r\u0103 a lua \u00een considerare gradul de uzur\u0103 al celor \u00eenlocuite.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Decizia judec\u0103torilor fa\u021b\u0103 de argumentele ap\u0103r\u0103rii<\/strong><\/h2>\n\n\n\n<p>Par\u021bial, Prim\u0103ria se contrazicea singur\u0103. Dac\u0103 drumul nu ar fi fost \u00een administrarea sa, nu ar fi avut ce amplasament s\u0103 predea c\u0103tre Delgaz Grid. Cu privire la celelalte argumente, magistra\u021bii Judec\u0103toriei au ar\u0103tat c\u0103 legea nu obliga asigur\u0103torul s\u0103 cear\u0103 aproarea Prim\u0103riei pentru a-\u0219i redacta documentele.<\/p>\n\n\n\n<p>\u00cen schimb, judec\u0103torii au fost de acord cu chemarea \u00een garan\u021bie a Delgaz Grid SA. Actele depuse la dosar ar\u0103tau c\u0103 lucr\u0103rile de refacere a drumului public fuseser\u0103 f\u0103cute \u00een perioada octombrie-noiembrie 2018, deci dup\u0103 accident. Prin urmare, Delgaz Grid SA era bun\u0103 de plat\u0103, \u00een contul Prim\u0103riei.<\/p>\n\n\n\n<p>Sentin\u021ba Judec\u0103toriei a fost contestat\u0103 de compania de gaze.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><\/ul>\n\n\n\n<p>Delgaz \u00eenlocuise \u00een zon\u0103 o conduct\u0103, dar nu rezulta de nic\u0103ieri c\u0103 groapa era rezultatul lucr\u0103rilor. Bran\u0219amentele de gaz nu se aflau sub carosabil, ci pe marginea acestuia. Lucr\u0103rile fuseser\u0103 efectuate \u00een afara carosabilului \u0219i fuseser\u0103 semnalizate corespunz\u0103tor. Groapa era aproape de mijlocul drumului.<\/p>\n\n\n\n<p>Argumentele Delgaz au schimbat decizia. \u00centr-adev\u0103r, automobilul fusese avariat \u00een urma contactului cu o groap\u0103 nesemnalizat\u0103 apar\u021bin\u00e2nd municipalit\u0103\u021bii. Sentin\u021ba Judec\u0103toriei a fost modificat\u0103 de Tribunal, fiind respins\u0103 cererea de chemare \u00een garan\u021bie depus\u0103 de Prim\u0103rie. Plata trebuia f\u0103cut\u0103 deci de Prim\u0103rie. A fost r\u00e2ndul Prim\u0103riei s\u0103 conteste decizia judec\u0103torilor.
