Sc\u0103derea acestei rate poate duce la limitarea accesului la comenzi sau chiar la dezactivarea permanent\u0103 a contului.<\/p>\n\n\n\n<p>\u201e\u00cen mod aparent, \u0219oferul este \u00abpartener independent\u00bb. \u00cen realitate \u00eens\u0103, prin mecanismul ratei de acceptare se exercit\u0103 o presiune constant\u0103 asupra acestuia pentru a accepta aproape toate comenzile primite, indiferent de rentabilitate, distan\u021b\u0103 sau condi\u021bii\u201d, se arat\u0103 \u00een scrisoarea deschis\u0103.<\/p>\n\n\n\n<p>Reprezentan\u021bii \u0219oferilor sus\u021bin c\u0103 blocarea contului echivaleaz\u0103, \u00een practic\u0103, cu pierderea instantanee a sursei de venit: \u201e\u00cen aceast\u0103 activitate, blocarea unui cont pentru acest motiv \u00eenseamn\u0103 faliment, acel transportator devine inactiv economic instantaneu.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cadru legal \u0219i acuza\u021bii de munc\u0103 for\u021bat\u0103<\/h2>\n\n\n\n<p>\u00cen document este invocat articolul 42 din Constitu\u021bia Rom\u00e2niei, care interzice munca for\u021bat\u0103. Potrivit semnatarilor, \u201eorice form\u0103 de constr\u00e2ngere indirect\u0103, prin amenin\u021barea cu pierderea accesului la munc\u0103, poate constitui o atingere grav\u0103 a libert\u0103\u021bii economice \u0219i a libert\u0103\u021bii muncii\u201d.<\/p>\n\n\n\n<p>De asemenea, este men\u021bionat\u0103 legisla\u021bia penal\u0103 privind exploatarea unei persoane \u0219i supunerea la munc\u0103 for\u021bat\u0103 sau obligatorie, precum \u0219i O.U.G. nr. 49\/2019, care reglementeaz\u0103 activitatea de transport alternativ \u0219i define\u0219te \u0219oferul drept prestator independent.<\/p>\n\n\n\n<p>\u0218oferii mai amintesc c\u0103 Rom\u00e2nia este semnatar\u0103 a Conven\u021biei nr. 29\/1930 privind munca for\u021bat\u0103, care define\u0219te acest concept ca \u201eorice munc\u0103 sau serviciu impus unei persoane sub amenin\u021barea unei pedepse \u0219i pentru care persoana nu s-a oferit \u00een mod voluntar\u201d.<\/p>\n\n\n\n<p>\u201eNu poate fi considerat\u0103 voluntar\u0103 aceast\u0103 activitate, deoarece aceste platforme func\u021bioneaz\u0103 \u00een baza unei legi \u0219i, mai mult dec\u00e2t at\u00e2t, de\u021bin pozi\u021bie dominant\u0103 \u00een pia\u021b\u0103\u201d, se mai arat\u0103 \u00een scrisoare.<\/p>\n\n\n\n<p>Solicit\u0103ri c\u0103tre autorit\u0103\u021bi<\/p>\n\n\n\n<p>Asocia\u021bia solicit\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Analizarea legalit\u0103\u021bii mecanismului \u201eratei de acceptare\u201d;<\/li>\n\n\n\n<li>Verificarea existen\u021bei unui raport de munc\u0103 disimulat;<\/li>\n\n\n\n<li>Clarificarea statutului juridic al \u0219oferilor \u00een raport cu platformele;<\/li>\n\n\n\n<li>Adoptarea unor m\u0103suri legislative care s\u0103 garanteze libertatea real\u0103 de a accepta sau refuza o curs\u0103 f\u0103r\u0103 represalii;<\/li>\n\n\n\n<li>Implementarea de urgen\u021b\u0103 a Directivei Europene 2831\/2024 \u00een legisla\u021bia na\u021bional\u0103, \u00eenainte de termenul-limit\u0103 din 2 decembrie 2026.<\/li>\n<\/ul>\n\n\n\n<p>Potrivit semnatarilor, m\u0103suri similare ar fi fost deja adoptate \u00een mai multe state europene, prin legi sau hot\u0103r\u00e2ri judec\u0103tore\u0219ti.<\/p>\n\n\n\n<p>\u201eStatul are obliga\u021bia de a proteja cet\u0103\u021benii \u00eempotriva practicilor abuzive, indiferent de forma juridic\u0103 sub care acestea sunt prezentate.
