Dar \u00een ce condi\u021bii pot fi utile \u00eenregistr\u0103rile?<\/p>\n\n\n\n<p>Poli\u021bistul Tavi Per\u021bea explic\u0103. Acesta face trimitere la articolul 97 din Codul de procedur\u0103 penal\u0103, cu referire la Proba \u0219i mijloacele de prob\u0103.<\/p>\n\n\n\n<p>(1) Constituie prob\u0103 orice element de fapt care serve\u0219te la constatarea existen\u021bei sau inexisten\u021bei unei infrac\u021biuni, la identificarea persoanei care a s\u0103v\u00e2r\u0219it-o \u0219i la recunoa\u0219terea \u00eemprejurimilor necesare pentru justa solu\u021bionare a cauzei \u0219i care contribuie la aflarea adev\u0103rului \u00een procesul penal.<\/p>\n\n\n\n<p>Proba video trebuie s\u0103 fie coroborat\u0103 cu alte probe, cum ar fi avariile, declara\u021biile martorilor sau ale persoanelor implicate. Doar astfel aceste \u00eenregistr\u0103ri pot fi luate \u00een considerare.<\/p>\n\n\n\n<p>\u00cen anumite situa\u021bii,&nbsp;<a href=\"https:\/\/www.promotor.ro\/stiri-auto\/cat-de-legal-este-sa-filmezi-traficul-cu-o-camera-video-de-bord-18725493\" target=\"_blank\" rel=\"noreferrer noopener\">camerele de bord<\/a>&nbsp;\u00eei ajut\u0103 pe oamenii legii s\u0103 identifice autorul unui accident. Dac\u0103 num\u0103rul de \u00eenmatriculare apare pe \u00eenregistrare, ancheta devine mai simpl\u0103.<\/p>\n\n\n\n<p>De obicei, cel care p\u0103r\u0103se\u0219te locul accidentului, nu recunoa\u0219te fapta. Film\u0103rile pot da astfel, o serie de indicii. Este de folos \u0219i \u00een cazul stabilirii dac\u0103 marcajul, \u00een zona incidentului, era continuu sau nu, dac\u0103 semaforul indica verde sau ro\u0219u. Camera de bord nu este v\u00e2n\u0103tor de contraven\u021bii \u00een trafic.<\/p>\n\n\n\n<p>Articolul 109 din Ordonan\u021ba de Urgen\u021b\u0103 195\/2002 arat\u0103 c\u0103:<\/p>\n\n\n\n<p>(1) Constatarea contraven\u021biilor \u0219i aplicarea sanc\u021biunilor se fac direct de c\u0103tre poli\u021bistul rutier, iar \u00een punctele de trecere a frontierei de stat, de c\u0103tre poli\u021bi\u0219tii de frontier\u0103.<\/p>\n\n\n\n<p>(2) Constatarea contraven\u021biilor se poate face \u0219i cu ajutorul unor mijloace tehnice certificate sau mijloace tehnice omologate \u0219i verificate metrologic, consemn\u00e2ndu-se aceasta la procesul verbal de constatare a contraven\u021biei.<\/p>\n\n\n\n<p>Sursa:promotor<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Camerele de bord surprind numeroase \u00eenc\u0103lc\u0103ri ale normelor din Codul Rutier.
